We know this is a bit late, but we still have today to act! There is a vote in Parliament this week could affect the future accessibility of Natural Health Products in Canada.
Many of the products used daily in Traditional Chinese Medicine, acupuncture, naturopathic, and allied health practices fall under the Natural Health Product (NHP) category. These substances, including herbal medicines, nutritional supplements, and traditional formulas, have been used safely for decades in professional practice and by the Canadian public, with a long record of very low risk when used appropriately.
In 2023, a regulatory change placed Natural Health Products into the same enforcement framework as pharmaceutical drugs. This change was introduced through a federal budget bill without consultation with the practitioners and patients who rely on these products.
As a result, NHP companies may now be subject to enforcement tools designed for high-risk pharmaceutical products, including administrative monetary penalties of up to $5 million per day.
Bill C-224 has been introduced to correct this regulatory imbalance.
The bill does not remove Health Canada’s oversight or its ability to protect consumers. Instead, it restores proportional regulation by recognizing that Natural Health Products are a distinct and lower-risk category that should not be treated the same as pharmaceutical drugs.
Smaller Canadian businesses that specialize in practitioner supply—particularly those importing and maintaining a full range of Traditional Chinese Medicine herbs and formulas—face significant challenges maintaining access to the products professionals rely on.
Practitioner-dispensed products already include an additional layer of safety because they are used within the context of professional training, clinical assessment, and patient supervision.
When regulatory pressure becomes disproportionate to the risk of the products themselves, the practical result is fewer products available, fewer suppliers able to operate, and reduced access for both practitioners and patients.
